Like many communities located along Colorado's Front Range, Fort Collins is experiencing rapid growth and related development pressures. Traditional agricultural communities and their cultural resources are being threatened by new development. Our firm has been retained by the City of Fort Collins to assemble current information relevant to this topic area. In particular, the City is seeking to better understand its opportunities for protecting such resources through:

  • The establishment of appropriate buffer areas;
  • Understanding useful methodologies for establishing such standards;

Subject: $21 Million in Cool Roof Rebates Available

The Local Government Commission (LGC) is partnering with the California Energy Commission (CEC) to help California reduce energy consumption through the installation of light-colored "Cool Roofs" that reflect rather than absorb heat. Through the "Cool Savings" incentives program, the CEC is offering rebates to reduce peak electricity demand. By reducing roof temperature by 50-60º F, these cool roofs offer many benefits to building owners and occupants, as well as the community at large, such as:

Local government, institutional and commercial buildings as well as some residential developments are eligible. If you are planning to re-roof an existing building or roof a new building in the next year, don't miss out on this opportunity! After September 30th, rebates will be reduced from 20¢ to 15¢/s.f.

The State of California also has a State Historic Building Code that can be used in lieu of Uniform Building Code when making alterations to designated historic structures. In addition, some California jurisdictions, including Oakland, have amended the UBC to facilitate adaptive reuse. I am in desperate need of any thoughts regarding decorative ponds. Our ordinance specifically list 20% criteria for open space in rear yards. The applicant wants to use 40%. That is if we consider a decorative pond as an accessory use. Should this use be compared to a swimming pool or should a text amendment for a special category on decorative ponds be written.? HHHEEELLLPPP!!! What are your thoughts?

Subject: Minor annexations of City-owned land without updated Master Service Element

Are there any communites pursuing or attempting to pursue minor annexations of City-owned land without having an updated Master Service Element? We have two City-owned parcels currently used for public purposes that are situated outside of and adjacent to the City limits. All City services are readily available. The local LAFCO has indicated that they likely will require the updating of our Master Service Element prior to considering the annexations. We would prefer to annex the parcels soon, and update the Master Service Element later this year when we undertake an amendment (reduction!) to our Sphere of Influence. Any comments or suggestions?

Subject: Parking Standards for Court Facilities

The City of Roseville is researching parking standards of jurisdictions which have county court facilities located within their Cities. The S. Placer Courts are looking to possibly relocate in Roseville and we need to let them know what we'd be looking for in terms of parking. In addition to the courts and administrative offices, they'd also include holding cells, so a straight office ratio doesn't really fit.

The Census Bureau has now started release of the first detailed data from Census 2000. The Summary File 1 provides data to the census block level for "complete count" subject matter items ... including the first data for ZIP code tabulation areas (ZCTAs). You can selectively download data from the Census web server and integrate these data with other data in GIS and other application environments. Does anyone know of any city in California that has designated "Religious" zoning? In most cities, churches are located within "residential" zones (or sometimes commercial or industrial) and operate under a Conditional Use Permit, but I have heard that some cities actually have separate zoning for churches. In the city I live in the "conditions" on the Conditional Use Permit are directly related to how loud the neighbors complain and vary widely from one location to another. If "Religious" zoning exists, I would also appreciate any information on how to initiate this zoning process change.

Subject: Standards for switching stations

Providers of high speed internet access (DSL, cable) need switching stations throughout the City of Carlsbad. These swtiching stations are small equipment buildings that can be placed above ground or mostly below ground. Does anyone know of review standards for these facilities? I am looking for aesthetic requirements and perhaps a tiered review process that allows well-screened or mostly underground facilities to be approved administratively, as opposed to the standard CUP requirement for "public or quasi-public utility installations." A web site address where I could look at an ordinance, policy, etc., would be helpful.

The Regional Planning Commission I work for has contracted to prepare a county comprehensive plan. Many rural residents of this county are adamantly opposed to county zoning on the basis that they do not want the government telling them what they can or can not do with their land. Does anyone have any suggestions on how to approach these people to help convince them that zoning has its merits? Thank you.

Subject: Substandard Lots

The question has been raised whether a lot that is substantially compliant (i.e. contains at least the minimum lot size 6000 sq ft) but is odd shaped (lot is rectangular with say a 45 degree taken out a one end built in 1948) is considered a buildable lot . Some say no that the lot does not meet the minimum requirements of 60x100. Others say that a creative developer could produce the minimum lot size. The real question is if a planner opts to deny the lot to be built upon then in essence is this a taking and does this constitute the denial of ones full use of property? Case law usually deals with built grandfathered uses but I fail to find much regarding vacant land that was developed before current standards.

My City is currently in the process of a comprehensive update of our General Plan. As is typical, we are considering a number of City revisions to our land use plan as well as a fair number of requests from private (and other public) property owners. My question is whether anyone has, or is aware of another jurisdiction which has imposed a "moratorium" on additional GP Amendment requests for a period of time following a comprehensive update effort. We are thinking about a period of a couple years following completion of the update while retaining the Council's ability to hear amendment requests that involve unusual or extraordinary circumstances.

I have helped form this group to address planning issues in Buellton, CA. Specifically we are making comment at the planning commission meetings, and responding to a Mit. Neg. Dec. on a project which is offering 3 acres of unbuildable land as "open space". This to allow him to dilute his project of 29 townhouses on .9 acres to 7.4 units per acre with the useless land included. "Open Space" is one element that is too loosely defined, hence the abuse. Any comments or suggestions about the legality of this, etc. would be appreciated

I am interested in finding any zoning by-laws or ordinances that discuss maximum floor areas of residential homes and the relationship to the degree of slope. In my working community there are vacant lots that are anywhere from 15,000 square feet (cluster lot) to 30,000 square feet plus (conventional lot. In addition there are cases where smaller homes are being demolished for larger houses. I have seen the Belmont California zoning with a slope to FAR table but the numbers don't work that well and the community relies on an absolute maximum and minimum. I have a 20 unit condo proposed for construction. The application is for a tentative tract map. The Fire Dept. wants a condition requiring a 10 foot setback where "openings" (windows and doors) would be considered "exits" (generally where the windows face the side and rear property lines). Right now, many of the outer walls have an 8 foot setback from the property lines. The Fire Code does not require this. An 8-foot setback is allowed if the windows are "rated." The Fire Dept. in Glendale does not want to rely on this provision of the Code. They feel there is a safety hazard here that needs to be addressed by a condition.

I would appreciate your comments about whether this is 1) an appropriate condition of approval of the tentative tract map, or 2) an environmental mitigation measure.

I am on a planning board that is dealing with a military base reuse issue.  In short, a referendum passed many years ago placed a 30 foot hieght limit on all development in the coastal zone regardless of the underlying zoning.   At the time the base was federal so it did not apply there.  Now the base belongs to the city.

The question has been raised, if the land is sold to the private sector or used for commercial or other private purposes does the 30 foot limit apply?  Some say yes others no.  The no taking the position that the zoning didn't apply at the time and it doesn't today as the reuse planning process will create a different zone with diferent height limitations.

I'd like to hear other comments on this.

Iif you are familiar with Michael Reynolds "earthships" website, solar, raincatching, human manure composting, indoor plants for oxygen, ideas --   that is what I feel is correct for the environment; but, if mankind is a social animal we should include private and public spaces in an optimum size group, say, 16 members, with designated quiet space and an asthetic daylighting and green space incorporated into multi-generational tribal housing "system"similar to the people of the longhouse or the South American Indian MOLLOCA which means both house and tribe and family. This could fit on a 40 x 40 pad or average lot thus housing 16 people rather than 3.5 per household.

BACKGROUND: The city of Carlsbad in northern San Diego County is undertaking a study which could join the northbound and southbound lanes of Coast Highway along the city's southern blufftop areas. These roadbeds are currently up to 200 feet apart and joining them would open up surplus land that could be used for coastal or shoreline access, linear parks, beach parking, passive recreational amenities, etc. Also involved is a potential land swap between the City and State Parks. The City is in the conceptual study stages.

QUESTION: Recognizing that there are numerous shoreline/coastal/blufftop parklands up and down the coast, I was wondering what state or federal funding or grants programs/opportunities are out there to assist with financing. Are there grants or funds that become available to a city if certain public access or public amenity features were designed into a shoreline park or coastal bluff overview type of project. Any input from coastal planners on shoreline park development and funding options would be very much appreciated. Possible field trips in January/February to further investigate certain sites if warranted.

I am a physical geographer and writer for Erosion Control magazine, the publication of the the International Erosion Control Association. I am researching an article about population growth and booming development in the Intermountain West, particularly along the eastern footslopes of the Cascade-Sierra mountains. I am looking for public and private sector people who are working with planning and zoning, stormwater, water resources, development standards, or hillslope and channel dynamics in these areas. In short, I want to talk with people who are working with the challenges of accommodating development in these lands of little rainfall.

Section 65940 of the Gov't Code requires local agencies to compile a detailed list of information that is required to be submitted by applicants for development proposals. Santa Cruz County has complied with this requirement for the various types of permits we process (commercial, coastal, subdivisions). However, the quality of materials submitted is not always consistent. Other than concluding that all required materials have been submitted, have any jurisdictions established a set of criteria to determine what constitutes a complete development application?

We, like most all other agencies, utilize a fairly standardized noise ordinance to address potential noise-generated conflicts/problems. We have recently run into a situation where a helicopter was used to lift and mount HVAC components on an industrial building in close proximity to a SFR area. This was done at 7:00 on a Saturday morning. I'm looking for real world solutions to this issue (beyond placing a separate set of construction hour limitations for helicopters). Hello from Colorado -

We in Boulder County have had a residential TDR PUD program in place for five years. We are now interested in considering some form of system that cold convert residential TDRs into commercial, business and/or industrial equivalents e.g. "x" square feet of commercial can be obtained by acquiring "y" residential TDRs or "y" residential square feet. One suggestion was to take the average cost of a TDR on the open market, comapre that to the average cost per sq. ft. to build C, B, or I facilities, throw in some FAR bonus ratio, and go with that.

I would appreciate any information or ideas you all may have or be aware of that deals with TDR conversions from residential to nonresidential uses. If this query is too vague, please let me know and I'll attempt to put in in a sharper context. Thanks in advance.

Because of several recent projects in which the original entitlement holder sold their project to a new owner, the County of Santa Cruz has initiated a process that requires the recordation of permit conditions on development proposals in the Office of the County Recorder. The purpose of this program is to inform potential new owners of all obligations imposed on the approved project by the County decision-maker(s). Do any other jurisdictions has a program like this? We're also interested in the mechanics of recordation in terms of who actually submits the conditions to the Recorder, who covers the cost of recordation, and if the entitlement holder records the conditions, how do you insure the correct conditions were recorded. I am currently pursuing my undergrad thesis in the redevelopment of 6 architecturally significant movie theaters in the Over-The-Rhine and West End neighborhoods of Cincinnati. I am concentrating on the adaptive re-use of the theaters as a way to encourage redevelopment and reinvestment in the surrounding distressed areas.
I will be exploring everything from the urban design of the facades and the surrounding area, to the implementation process of such a plan.

My planning firm is currently in the process of developing design guidelines for several towns and cities in Maine. Signage has been a particularly contentious issue in the course of our work with local communities--citizens are clamoring for fewer, smaller, and less obtrusive signs, while business owners are adamant that signs must be big, frequent, and bold in order to sustain business health.

I am trying to find out if any studies have been conducted on the correlation between traffic accidents and road corridors that are particularly cluttered (and thus distracting) with commercial signs. Can anyone give me a lead?

What should an ordinary citizen offer an inexperienced planning dept in a 600 sq mile rural county in Washington where old, codified, entrenched planning rules are sprawling from one city, from scattered patches, and along an Interstate?

You experts know the situation - far-flung homes, schools, commerce connected by roads - clogged, widened, clogged again, take more agri-land, more roads, etc. Somewhere in this great land these troubles have been addressed and remedied for long-term preservation of precious resources, some growth, and quality of living.

Maybe this situation can be turned a little for the better? Experiments going on somewhere? Successful projects on scales of a few hundred sq miles?

The Lux Institute is a non-profit entity proposing to develop a facility within the City of Encinitas, a coastal city found in northern San Diego County. At this facility, artists would live on site and produce work for exhibition. Nearby schools or  other interested parties would be able to visit the facility to observe and learn from the artists in residence.

The proposed facility is a unique "use" that does not fit into any of the City's land use or zoning classifications because it can be considered to be similar to a school, art gallery, museum, aquarium or botanical garden. A zoning code change may be necessary to include this use category.

I am interested in learning how other cities may have classified any similar uses. All suggestions, comments, or referrals to other sources of information would be greatly appreaciated. Thanks.

Has anyone developed zoning controls or specific findings for discretionary actions limiting chain stores in neighborhood type commercial districts? In San Francisco we've recently had a number of heated battles over various retail, restaurant and drug store chains - again. Most of the parties involved seem to agree that neighborhood character, identity and quality of life are at risk if generic retailers proliferate displacing local businesses, yet there do not appear to be legal means of restricting them and developing a meaningful public decision process. The Office of Administrative Law (OAL) formally approved the proposed comprehensive changes to the CEQA Guidelines on October 26, 1998. This completes the rulemaking process begun in October of 1997. These changes take effect immediately.

Some important areas of change include clarification of the determination of whether a project may contribute to a significant cumulative effect, clarification of how to analyze historical resources, rules for the recirculation of a negative declaration, guidance on preparing mitigation monitoring or reporting programs, clarification of mitigation measure preparation, clarification on the use of tiering, clarification of the limits on the use of categorical exemptions, and two new categorical exemptions for minor cleanup projects and historic rehabilitation. In addition, a new Appendix G has been adopted which revamps the initial study checklist.

The 1999 APA National Conference in Seattle will be the inaugural year for the AICP College of Fellows – a group of distinguished AICP planners recognized for their outstanding contribution to the profession. The new program is similar to AIA, ASCE and ASLA programs and election to the College of Fellows will be one of the highest honors AICP can bestow on a member.

CCAPA has established a process through its Sections for review and support of nominations; however, an individual member of AICP may be nominated without going through the Chapter process with support of 10 other AICP members. I am looking for a few good examples of planning dept administrative procedures manuals. We are undertaking a complete review of each dept's procedures and I could use the help in updating my dept's. Above all, I need to produce a quality product that will be the envy of the public works director.

The Office of Administrative Law approved the following amendment to Section 15064(i) of the CEQA Guidelines on August 24, 1998. It takes effect immediately.

This amendment is intended to bolster the use of "thresholds of significance" and to clarify that compliance with standards and regulations for the protection of the environment can be used to determine the significance of a project's impact.

The set of comprehensive amendments being proposed by the Resources Agency is still in the rulemaking process and has not yet been submitted to the Office of Administrative Law for consideration. A decision on that set of amendments is not expected until October.

15064(i)
(1)(A) Except as otherwise required by Section 15065, a change in the environment is not a significant effect if the change complies with a standard that meets the definition in subsection (i) (3).

(B)    If there is a conflict between standards, the lead agency shall determine which standard is appropriate for purposes of this subsection based upon substantial evidence in light of the whole record.

(C)    Notwithstanding subsection (i)(1)(A), if the lead agency determines on the basis of substantial evidence in light of the whole record that a standard is inappropriate to determine the significance of an effect for a particular project, the lead agency shall determine whether the effect may be significant as otherwise required by this section, Section 15065, and the Guidelines.

(2)    In the absence of a standard that satisfies subsection (i)(1)(a), the lead agency shall determine whether the effect may be significant as otherwise required by this section, Section 15065, and the Guidelines.

(3)    For the purposes of this subsection a "standard" means a standard of general application that is all of the following:

(A)    a quantitative, qualitative or performance requirement found in a statute, ordinance, resolution, rule, regulation, order, or other standard of general application;

(B)    adopted for the purpose of environmental protection;

(C)    adopted by a public agency through a public review process to implement, interpret, or make specific the law enforced or administered by the public agency;

(D)    one that governs the same environmental effect which the change in the environment is impacting; and,

(E)    one that governs within the jurisdiction where the project is located.

(4)    This definition includes thresholds of significance adopted by lead agencies which meet the requirements of this subsection.

"Urbemis7G" has just been released on the Internet. Urbemis7G is an updated and expanded version of the "Urbemis5" program used for CEQA air quality analysis of development projects. "Urbemis7G" was developed by Jones & Stokes for California air districts, and its use is now recommended. Urbemis7G is more user-friendly than previous versions. And, for the first time, a new "Mobile Source Mitigation Component" can estimate the benefits of land use and transportation mitigation strategies in reducing vehicle travel and emissions related to development projects, such as: the availability of transit, pedestrian, and bicycle facilities; the design and mixture of land uses; provision of on-site services; and telecommuting and other "TCMs". In addition, Urbemis7G also now can estimate emissions from construction activities as well as "area-sources" (such as appliances, landscape equipment, etc.). We are involved in litigation regarding placement of a cell phone monopole in a residential neighborhood. The proposed tower is 125' in height and is proposed for a location which the local zoning ordinance states shall "in no case" be used (between a major building and road). The city counsel has waived the zoning restriction and we are seeking injunctive relief. We would prefer a stealth site in a church steeple located across the street from the proposed site. The issue in part revolves around the impact of a cell phone tower on abutting and nearby residential property values. Does anyone know of reputable studies on the issue?

Anchorage Alaska has created a Renaissance Zone to encourage economic development. Copies of existing projects of similar nature, or agencies to correspond, with would be helpful.
Although Anchorage never went through the industrial revolution, it had an earthqwuake in '64 that leveled the City so we really have nothing to renovate. However, the sprall that followed needs a re-think and not only in terms of street scapes.

The City of Carlsbad, in northern San Diego County, California, will be site of a new theme park, LEGOLAND California which should open by the end of 1999. Given this new "magnet" in the City that will attract many people to the area, there is a community concern about maintaining quality of life standards. Concerns center on vacant, infill lots with commercial designations or existing commercial projects and the range of potential future use changes. The volume and/or nature of commercial development or use changes will be different given the presence of a theme park.
Therefore, Planning Department staff has been directed to create an overlay zone to address the build out of vacant commercial/tourist serving properties and regulate use change requests for existing commercial projects. The theme park site is part of specific plan area (Carlsbad Ranch Specific Plan) located south of a coastal lagoon, just east of Interstate 5 with industrial office parks nearby and residential areas in the surrounding vicinity. The City already has a Growth Management Program to address basic facility and service needs.


The overlay zone needs to prevents an invasion of tackiness into the city; prevent a proliferation of liquor stores, gas stations, mini-marts, T-shirt shops etc.. Aside from looking at separation type zoning regulations, the City was wondering if there were any innovative or highly effective approaches taken by communities to deal with the presence of a "magnet" in their area. What successful techniques have been used to maintain quality of life standards and prevent an invasion of tackiness for areas with significant historical or cultural sites?; areas with theme parks nearby?

Subject: "Termed" Use Permits

Our jurisdiction is exploring options available to establish a system of "termed" permits. That is, a conditional use permit that contains an expiration date (which could also be amended to extend its expiration). The purpose would be to monitor a use that may, for unforeseen reasons, conflict with or result in a nuisance to surrounding uses. We foresee these permits being used in circumstances where a tenant wants to occupy an existing building where the full range of development standards are not meet due to ordinance revisions (such as a lack of parking). These uses would not fall into the category of temporary uses such as Christmas tree or pumpkin patch lots which we already have a permit system for regulating.

Does anyone have any experience with such a mechanism? And what have been the results? We've contacted APA's Planning Advisory Service but they didn't have much information on this topic. Copies of any ordinances that are available can be mailed to me at the address below. Thanks for your help.

Subject:  Boundary Line Adjustments, Zone Changes and/or general Plan Amendments

The question is, what do you do with a Boundary Line Adjustment (BLA) that is also on a zone and/or general plan boundary? A lot of these adjustments may only be for a few square feet to resolve a problem with the subject parcel. Do you simply ignore the zoning and general plan lines? What if both parcels are zoned residential but the minimum parcel size requirement is different? California state law would seem to require that the applicant for the BLA submit a full application for a rezone and to change the general plan. This may cost several thousand dollars and would make the BLA infeasible. Has anyone come up with a simple and cost effective way of processing such a change? Subject: Agricultural Conversion of Sensitive Habitat Areas

I am currently working with a group composed of Sonoma County grape growers and environmental groups regarding development of new vineyards on hillsides. The participants have reached conceptual agreement on issues related to erosion and sediment control. We are now wrestling with the more difficult issue of habitat protection. The primary issues are protection of oak woodlands and riparian areas. The growers are generally resistant to any restrictions on where vineyards can be developed. The environmental groups are concerned that a great deal of native habitat has already been lost and that what's left is becoming increasingly fragmented.

I am familiar with sensitive habitat protection policies and regulations aimed at nonagricultural development, but I am not familiar with any attempts to restrict agricultural development (which generally occurs as a permitted use under most zoning ordinances). I would appreciate hearing from anyone who has addressed this issue in other jurisdictions, or from anyone who has thoughts on this topic. Thanks!

I manage a unit which includes public counter operations. Much of our business includes both walk-in and phone traffic. We currently staff our counter with one permanently assigned planner who is available to walk-in customers, AND answers the phone. We used to staff this operation with three or four planners, (it is a busy operation!) I'm wondering if other jurisdictions have a similar customer service operation, and what the staffing level is for it. Demand is high for our services, but convincing the budget authorities to fund this valuable service is a difficult task.

The city of Oxnard is currently negotiating with a theater operator for a multiplex in downtown and has received concerns that certain uses might not benefit the theater.
