Innes Miller Mediations has been established to offer a mediation service to individuals and businesses involved in Agriculture, Land-use and the Environment in Scotland.

It's a new, alternative route to settling disputes, working on the principle of conciliation - in place of conflict.

Civil Disputes take time and money. Frequently to the detriment of one or both parties, they are settled in haste to avoid court proceedings. They can be stressful and bitter, destroying any opportunity of recreating a working relationship.

In short ... civil disputes are costly.

Now, through the services of Innes Miller Mediations, settlement of disputes can be achieved swiftly....and at low risk and low cost.

The trained skilled mediator act as a catalyst and a go-between to help the disputing parties reach their own agreement. The process is voluntary, private and without the outside pressure of publicity which can be detrimental to negotiations.

 

How Mediation Works

Mediation cases can be initiated by one party, or their legal representatives. If both parties have already agreed to mediate, arrangements can be made on mutually acceptable dates and location.

Occasionally, the mediator will have to assist in convincing others to participate; a resolve by one part to seek mediation is not a sign of weakness.

Each party to the mediation is bound by a confidentiality clause in the agreement setting out the terms under which the mediation takes place. Participants must come to the mediation with full powers to negotiate and sign any agreement.

The mediator will discuss the problem separately and privately with each party, exploring the options for a settlement. The proceedings are voluntary so any one is free to leave the negotiations at any time. The mediator may terminate the session if he thinks that no progress can be made.

Successful mediation usually ends with the signing of a legally binding agreement.

Innes Miller's experience as a farmer, businessman and holder of a number of public appointments has given him a unique insight into the complexities and conflicts frequently involved in the multiple us of land.

In Caithness, both as a tenant and a landowner, he farmed 4,000 acres growing arable crops and producing lamb and beef, sound, practical experience that has given him a deep understanding of all aspects of Scottish agriculture.

Chairman of the Red Deer Commission for nine years, he was also a member of the Countryside Commission for Scotland and has served on various advisory committees for Highland and Islands Enterprise, the Scottish Agricultural College and the Scottish Office.
